A&Z received the Written Verdict from Shanghai No.1 Intermediate People Court on October 30th, which is stating that the claim of jurisdiction objection from us was rejected by the Court.

A&Z would like to confirm whether we plan to put forward the appeal relating to the Written Verdict. If so, it’s better for us to claim it by the date of November 6th.

A&Z also said that since  DSCN not received the written opinions from 普德,so DSCN could consider to appeal so as to race against time (If 普德 could reply their opinion in time, DSCN could choice not to appeal) .

Relating to the current situation, Miyata-san, my personal opinion is that it might be better for DSCN to claim the appeal. the reason are as below:

1)    It seems that 普德 don’t want to support us, so, it’s difficult for us to receive their reply timely.

But the proposal for appeal it not for waiting 普德 but for giving us more time to prepare this case.

2)    From the cost of litigation, it’s seem no additional cost which DSCN need to pay except the cost of appeal;

3)    To reinforce the attitude of claiming  jurisdiction objection (right to run out could prove that we are really disagree the claim from 美享).

Above is reference for Miyata-san, if we need to claim the appeal, I will reply A&Z to prepare relevant materials, if not, I will reply A&Z it so.

PS: These two below screenshot are respectively from minutes of meeting with 誉衡ã€æ™®å¾·å¾‹å¸ˆ on September 25 and the Written Verdict from the court.

The entrusted agency 王然 is the same person who was meeting with us by Webex in September , but his attitude in the court was passive and not supporting us, which is different from the meeting on September 25.I thought his attitude might be the attitude of 普德. So, A&Z also should not depends on 普德,they might need to have a plan B which is that what should we do if 普德 complete lack of coordination.

A&Z also said that since DSCN hasn’t received the written confirmation letter from 普德,so DSCN could consider to appeal to buy some time (If 普德 could confirm on time, DSCN could decide not to appeal) .

With regards to the current situation, may I suggest that it might be better for DSCN to claim the appeal for the reasons below:

1)    It seems that 普德 doesn’t align with us, so, it’s difficult for us to receive their reply timely.

We should use the time to prepare for the case instead of  waiting for confirmation from普德.

2)    In regards to the cost of litigation, it’s seem that DSCN has no additional cost to pay except the cost of appeal;

3)    To reinforce the attitude of claiming  jurisdiction objection (to use up the rights we have, and further prove that we strongly disagree with the claim from 美享).

Please consider the above for your reference, if we need to claim the appeal, I will reply A&Z to prepare the relevant materials, if not, then I would reply them otherwise.
